Try noisy fan in your window for a couple of nights (even if you point it outward). You won't hear him and the loud manmade noise may cause him to find a new resting place.... or should I say singing place.
If you live in an unsafe area, and can't leave a fan in an open window, then set it outside the window with an extension cord.
One way is to purchase a plastic Owl. They are sold at you local hardware stores and even at Walmart. Place it in the tree that the bird is in. It should keep it away.

Go to your local Home Depot and buy a fake Owl and put it where the bird can see it. Good luck.
get a slingshot, and use garbonzo beans as ammo.
My dad had a mockingbird problem a couple months ago, and he used this method. It scared them off for good!
You can go to walmart to get a slingshot (about 6 or 7 bucks)
and garbonzo beans at the supermarket (about 75 cents)
It's non lethal too! and it won't shatter you're neighbor's windows either
