What do I do if my ex wife is breaking our custody agreement arranged by the courts? I am supposed to get my daughter half of the time, we are to split holidays, she is to make accomodations for me to see my daughter. She has done none of this. I have called her, and texted and emailed her and nothing. She calls my parents and says you can come get devin(MY DAUGHTER) at 8am and bring her back at 4pm i need a babysitter. Those aren't the stipulations of our custody agreement. Also she is living with another man, she is using my daughter against me. When my mom calls to see if we can have her for the weekend she blows us off for two weeks without any contact, then out of the blue she'll call and say pick devin up at 8am at my work and bring her back at 4pm at my work. Should I file apers at the court to take her back to court to gain sole custody? We already went once and I won the case, I agreed to joint custody and I would pay child support. The judge thought it was very admirable of me to offer this, and he told her she was immature and irresponsible for the things she was telling the courts without proof and it was just badgering her said. She was tyring to belittle me and embaass me rather than gain custody. Anyway, should I go back to the courts and try for sole custody?

Thank you very much, my girlfriend and I are both writing things down everyday. Such as yesterday my mother called her because she won't answer the phone when I call.. So she called and asked if we could have our daughter, she said well i probably won't need anyone for another 2 weeks so no you can't see her. In court as soon as I walked in i told the judge let's get the money out of the way because it's the least of my worries I want to pay for my daughters health and food and clothing, so he assigned child spport... after that I told him I did not want sole custody because I would never keep my daughter from seeing her mother and i would not keep her from what she has known her entire life so far(she is 4 almost 5) and I told him I just wanted to see my daughter without any hassle and i wanted to be a father to her, i broke down in tears and he saw right through my exes plan. He then preceeded to ask me what custody i thought was suitable, i explained the joint custody.
