okay so ive had enough with the way my employer treats me, im a legal hispanic. i work as a server assistant at a restaurant. well the reason i would like to sue is because i feel like my employer is taking advantage of me. ive been working for six months and havent gotten a raise. im their best employee but it seems like the more they see how good i am, the more work they pile on me. without giving me a raise. im only 17. the legal age for washing dishes there is 18 yet they still make me wash because they know that i will do it for server assistant pay which is 6.50 an hour. also theres another hispanic there which cant speak english so they see him as a target and make him wash dishes and do fry station at the same time for lower pay than the average dish washer. can i sue?

The legal age to wash dishes is 18? What State do you live in? Before doing anything, check THAT statement of yours out with the city and or State. Sounds like the other guy is illegal if he doesn't speak English, This dish washing thing, do they supply you with gloves? and what chemicals do they use to clean the dishes? They may be breaking some laws, but the way I see it, YOU would be better off getting your high school diploma or a GED Test, so when you are 18 you can get another and better job. The way things are right now, jobs are hard to find, and sometimes a person has to bite the bullet unti things start getting better. Check with the State to see what the minimum wage is, and, as you are still a minor, how many hours can they legally work you!!! You can't sue them for not giving you a raise, personally, I would grin and bear it and aim for something better than a dish-washer!

I've been working for 3 1/2 years without a raise and I feel damn thankful I have a job.
During that time I've save them a quarter million dollars in hard cold cash, and I haven't gotten a raise.
Half the people I know have lost their job. So, yeah, I'm pretty happy with getting no raise. You should be too.
You are not entitled to a raise until the boss feels you earned one or have a contract stating when you get one. Obviously your boss does not feel you have earned it and you do no have a contract. So No you cannot sue for this issue. As to the rest of the issues you report them to the local labor board in your state. Then you should look for another job in which you might be happier.
Why sue them? If you dont like it, leave! Get another job and move on.
Why does everyone seem to think that suing someone is the answer?? If I fall over, its my fault not the shopping centre or wherever I happen to be.
Originally, the court process to sue someone was for extreme circumstances, such as getting run over by an uninsured driver and having excessive medical bills not because you feel hard done by.

you have to think the coming age of you because your age is 17. if you are near to 18, dont sue them. just patient. if need to more than 6 month or more, as you like. but you are not in the legal condition to work. Suing can be make if you want. but not certain to win. i am not a lawyer. but i learn about the ACCA part 4 business law. if they are not force to do the job, you have a mistake too as knowing about the working age, but doing the job. You just need to negotiate them.
