I was wondering if anyone has been in the situation where you were in and accident and not at fault. Had to get a rental car, but the rental car company gave you there "standard car".... Like in my case I drive a Yukon XL and the rental company gave me a Chevy cobalt... Is this right, It just seems like they need to give me a vehicle that is like mine. Especially because i have 4 kids and we need that extra seating and the trunk space.
Is there any type of rule or law that states the insurance company of the person that is at fault. Has to pay the cost for the larger vehicle ?
Update:Let me say this, Im not looking for a Yukon XL Denali like mine. I understand that. I would just want a larger Suv, like a bare bone Suburban.

You are not entitled to a comparable car. The insurance company is only obligated to pay for basic transportation.
If you have a reasonable need for a larger vehicle (4 kids is a reasonable need), then you can get something with a larger interior, but you still won't be allowed a Yukon.
The only state where you can get a comparable car without reason is NJ.
Well in cases where cars have to be loaned because of the owner's vehicle is going to be in service for an extended period of time, they will usually only give you what's available. A large vehicle such as the Yukon or it's equivilant costs more money for a rental, but it's weird how it works out. For example, when my family's minivan had to be in for service a number of times, the first time, they gave us a Honda Accord, another time was a Chevy Monte Carlo, then a Kia Sorento, then a Mazda 3. When our Buick was in for service, they offered us a large cargo van, but we were like, no thanks. For another one of cars which was a midsized car, they gave us a Ford Focus Loaner, which is a compact. I think it's really based on what they have available. I'm sure if a panel van was the only thing left, it would be offered and the same case goes for whatever car is available and doesn't have a reservation attached to it. If there was a vehicle of the equivilant of the Yukon XL such as a Suburban or Expedition EL, you probably would've gotten one, but I guess it's that annoying first come, first serve basis.
no be glad you got one at all , it sucks but honestly, I choose to make lemons of lemonaid. I rented the baddest, car the company had, a convertible 5.0 mustang brand spanking new So I suggest you off set the cost and pay for what you need or let it go alltogether. I ran around town telling everyone I bought the car from some old lady 500 bucks in the local papers.worked great, until I had to take it back. Oh well life goes on sometimes you have to do what you have to do.
I have that sort of policy for my car. I don't think it matters whose fault it was in the accident - your policy will dictate what kind of rental car ($$$ it comes down to) you will get. Best to read your policy and speak to the them directly about this to confirm. (I have AAA.)
you're going within the fallacious path you have got to make it a CIVIL MATTER sue him for damages.. additionally for hardships placed on you... lack of wages.. lack of automobile... however without a fault what's the concern your corporation has to pay you..NO FAULT INS..appear at your coverage.. then your companyh will acquire from the opposite motive force. good enough..
