My daughter (NY raised) lived with her husband in washington state for a year. then the last 3 months they had a baby . so the child lived there 3 months .they moved to his fathers neighboorhood in Texas. there was physical abuse to my daughter . so after 4 months there she used her 2 week vacation to see her family In New York and use it as an out to get away from the physical and emotional abuse ...the husband now wants to move back to his mothers house in washington and she thinks she can get her son to get custody for 6 months at a time. my daughter is still nursing but even if she werent . can he get custody for that long ? no child should be taken away from their mother that long . there were no police reports filed she just got out ..the husband is either 21 or 22.. In July of 2012 he told me while i visited ..that when he was a teen he assaulted someone that resulted in him to be temporarly in a psyche ward for a while .

Unless someone in the legal profession see this and answers you will get nothing but opinion. See if there is a women advocacy group in your area who can help, if money is the issue. The laws vary from state to state. If she can prove the abuse by testimonials from friends, neighbors, police or hospital have her get that information together now for presentation to her counsel.
Bad situation no matter what happens, good luck to your daughter and her child.
Your daughter needs to talk to an attorney where she resides with the baby.
If she meets the residency requirements,she can file for divorce there and the father will have to fight for custody in court where the child lives.
She also needs to prove abuse to her by her husband if she wants to use that as a reason for a divorce.
His mother cannot get custody of the baby,just as you can't either.
Custody will be determined by a court unless the parents can offer a workable solution or 1 parent files for sole custody of the child and support from the other parent.
A lawyer should be able to get confirmation of assault case and psyche ward confinement.
Generally,juvenile records are sealed once a person is an adult,but a court order can get them unsealed.
Many lawyers offer a free initial consultaion,so it won't cost you anything to at least talk to them.
Some may do a case for free or at reduced rates if you are willing to do some of the work for them.
You can also check with a local Legal aid group to see what services they provide or can recommend an attorney to you.
I don't think that will happen. The child has primarily been with your daughter. They must have some documentation of his assault on the teen. Plus it would have been in the best interest of your daughter if she had documented his abuse or at least report it. You should contact Legal Aide in your state they might be able to do your case Pro-Bono or on a sliding scale. It's worth a try.
