Yes they do. I don't know what state your in but in most instances a probable cause affidavit is prepared by the arresting officer which is then taken before a magistrate where a complaint is filled out, this can be a judge or a prosecuting attorney. The complaint is then filled out based on the sworn affidavit of the officer and then forwarded through channels, a misdemeanor to the county attorneys office and a felony to the grand jury via the district attorneys office.
I would suggest that you go to your district attorneys office, see the receptionist and tell her who you are and what your doing and she can probably help you a good deal, district and county attorneys are elected officials so they are usually receptive to helping students. If there is a large number of you I would suggest that one of you go by first and make arrangements beforehand for the group to come in when it's convenient for the staff.
By the way, a divorce is not criminal, it's civil and a civil action is started with an original petition.
Depends upon the rules of procedure in your state. In mine, yes . . . the DA files a Complaint for any criminal offenses charged. If it's a felony, then the DA will later file an Information (which is formatted exactly the same as the Complaint) after the defendant is held to answer. Other jurisdictions may not use Complaints, however.
No, not exactly. Criminal cases use either an Indictment or an Information. This depends on the constitution of the State bringing the charges, or if it is federal charges then there is an Indictment. If you would like a sample Complaint, send an e-mail to me and I'll give you the generic form used for Divorce in Arkansas. I won't fill it in with real people's names - it will be John and Jane Doe.
The first filing of most cases is also known as a complaint. (google search for: mandamus complaint)
Get this clarified from your instructor as there is also a police complaint that could turn into a court case.
E.g. if someone breaks into your house and you call the cops, you sign the 'Complaint' that the thief broke into the house and the police needs to do something about it.
Or you call the cops and 'complain' that there is a strange noise from your neighbors house and the next thing you see is your neighbors in court for making illegal CDs.
this is a 2 area question, First the subpoena Deuces tecum calls for the subpoenaed social gathering to carry the listed products to courtroom which, is mostly listed as all information acceptable to the case below discovery regulations. once it really is accomplished the criminal professional would enter this into courtroom information. That which isn't entered into courtroom information is retained by the police. 2d area...If a case is disposed of in courtroom and punctiliously closed by the police then, the assistance pertaining to the case is public list. This usually required a request variety and a pair money for replica costs. I stay in Florida and would not be effective of massive apple regulation.
