Don't worry too much about it. I got a 3DS and used it right out of the box. It only says that for liability reasons so nothing can be blamed on them.

By the way, since you just got a 3DS, I would recommend you get Ocarina of Time 3D. I played it and the game is amazing in all aspects, and has very high replay value.
