I'm missing out on some factors I'm sure. But it is considered cruel and unusual punishment to force someone who is trans to do time in a facility of the opposing sex especially in the general population if they cannot visibly pass as the same sex.

'Ladyboys' can never have their passports changed, so they are ALWAYS classed as men. No if's and's or but's.
Even in some 'Western' nightclubs, where the management does not allow them entrance - ALL women have to show their passports as proof they are women, to prevent the better looking of the ladyboys from slipping through the net.
So clearly, the government does not distinguish the law for transexuals, so you should expect that they goto prison with other men - where I'm sure they get 'more than they anticipated'.
courts decide this on a case by case basis. Usually it depends whether they are pre or post op but other factors come into play as well. regardless it is worse for them than any other prisoner so they would be smart to avoid committing any crimes.
I guess it depends on the state. For one state, I heard that transgender teens could be put in prison with the gender that they identify as. It depends on the place and also probably pre-op and post-op.
I'm gonna guess.... current. I mean.. they'd wanna be seen as what they currently were right? so they wouldnt wanna be put in with people of their previous sex.
regardless of what sex they are right now they will be placed with the same gender as what he was born as. don't you watch the tv show lock up? they have men in there that look like some of the prettiest female i've ever seen but that is not there birth gender.

Most states will incarcerate She/he in what ever facility the their physical sex represents.
Example:
A post op M2F would go to a Female prison. pre op to a Male prison. and for a F2M pre op to Female prison and post op to Male prison.

unless they had a sex change they would be imprisoned with inmates of their previous sex

Depends on their genitalia. If they have male junk, they go with the males, and if they have a vag, they go with the females.
