It depends on what you contract for. An oral contract is never leglly binding in real estate. (I don't know anything about "for passing title"). Also, oral contracts are very hard to prove. It often becomes a "he said, she said" ordeal.
Yes. And contrary to what the above say -- oral contracts for land are valid, but are not ENFORCEABLE. The difference is that a court won't enforce it, but it will be good to pass title.
