I am a little confused with the definition of non-custodial parent and custodial parent. My ex-husband has legal and physical custody of our children, but according to the order I spend more time with our children than he does. I get them the entire summer and once a weekend in a month (including holiday). He has them every other weekends because our children lives with his mother and we both live out of state.
Is it right for a order to state that he has physical custody of our children when our children do not live with him? In addition, I have our children more than he does. Does it matter? Yes. I would like to regain custody of my children again. The order states that we are both fit to raise our children, but he has choosen not to raise them because of the inconvenience it places on his life.
I am doing very well. Very well! Would it be easier to reverse custody if he has not made any attempt to raise his children within a year?

if you have the child more then your need to go back to court and tell them you are having the children more often.and would like to go for full placement.
In WI: If the non custodial parent will not / cannot spend time with the child & will be living in a home other than the home of which the children reside. NO! Thats why they have custodial parents. BUT: The child has the right to choose when they turn 16.
