If you are separated from your spouse, they left to across the country, how long until you are considered divorced. It's been 4 years, does the divorced have to be paid for and filed?
It is not a "waiting" game and a divorce is not filed. That makes no sense. When the judge grants the "Divorce Decree", you are then divorced, immediately. The spouse can be anywhere in the world at the time. That has no bearing on the status of the divorce case and neither does the fact that you may owe payments to your attorney. If you are making regular payments, good. You will still be considered divorced when the decree is signed and issued.
Why are you now, 4 years later, just asking whether you are divorced? Did you stiff your lawyer? The lawyer does this for you and this is how you repay her?
In my country a couple have to be separated for 1 year & then one or the other files for divorce.It's from that date & another year on & the courts end the marriage agreement & you become single again. Who ever files for the divorce, normally pays for the divorce settlement. But best you check with Birth, Deaths & marriages at your local court who will advise you where to from here!

Divorce just does not have a waiting period to be legalized if one of the two married individuals takes off and leaves.
Divorce papers must be filed and the marriage must be disolved in a court of law for it to be a legal divorce. Nothing else will do.

No you are never considered divorce. You have to get divorce papers signed and filed.
You need to make it legal, if you plan to marry again.
