If you want to do it by yourself just go to the court (district court where I live) that handles small claims, file the papers and have them served. Sure you'll only be able to collect up to 3000-5000 depending on your juristicinal limits. If you want to sue for me, way more complicated and you'll need a lawyer because I don't believe you'll be able to handle the discovery process and depositions by yourself.

Go up to the person in charge and tell them you are about to get SERVED DOG.
Then contact a Lawyer and tell them about your problem and they will SERVE the Employer.
Tort claims should be illegal.
Otherwise, wrongful dismissal claims vary state by state in the U.S., and vary country by country.
In many countries, there is no such thing as wrongful dismissal, and the employee is just out of luck.
Wherever you are, check to see if there is a Labor Department, and start doing your homework on what rights you might have.
