You don't HAVE to restore it (the computer technician will do that later).
Just return it before the warranty expire.
Do NOT let them convince you about taking it back, once the warranty is over you lose the right to return it. Get the money and buy a different brand or model.
I had the same problem with my first computer (constant crashing, and one day didn't turn on); the sales guy tried to talk me into sending it to repair but I said "no" (he knew my warranty was about to expire).
I got my money back, I checked the computer reviews and bought a different brand.

It depends on the retail store from which you purchased it from.
Most retail stores allow a 30 day return.
It's best to factory restore it or just delete your personal information from it.

Most allow returns within 30 days of purchase.
I wouldn't touch it, I would just return it as is so they can diagnose what the problem is and maybe they could even repair it for you.
