I am writing a story, and my protagonist's father died in a car accident he caused while driving drunk. He ended up killing the other person, and I would like to have it set up so the family of the innocent victim sues the dead man's estate, in effect suing the protagonist who is the only next of kin. I am just curious if that would be possible.

it's called "probate" - the heirs don't get to be heirs until the "debts of the dead" have been paid off.
You certaintly can sue a dead man's estate. A person does not relieve himself of his legal obligations simply because he dies. his
