If i dealership can't find a bank to get a loan can they keep your down payment? the car is brand new but i been using it for the past weeks and has 200 more miles then when i got it. so will i be charged even if it wasn't my fault

No they cannot keep your down payment unless they sell you the car. You gave them that money as a down payment to purchase the car--not to borrow it for two weeks. There has been a breach of contract in that you cannot buy the car. The contract is null and void and you get your money back. They shouldn't have put you in the car unless they knew they could get you a loan. The use of the car is the dealer's fault and they have to deal with it.
Even with 200 miles on the car it is still a brand new car because it was never titled in your name. Trust me, they'll still sell it as new. Maybe with the fancy term "demonstrator" and a bogus $500 discount but it will be new.
Two interesting facts. The warranty on a new car doesn't start until it is officially sold. So, a 10 year / 100,000 mile warranty on that car would actually cover it until it has 10 year / 100,212 or however many miles it actually has on it when it is sold.
Second interesting fact. All BMW's sold have at least 50 miles on them when they are sold new. They pride themselves on having actually tested their new cars to be sure all the bugs are worked out.
