If we had custody of my husbands 14yr. old when she had her baby, who had custody of the baby? Did we? And if we gave custody of the 14yr. old to her Biological Mom, would we need to give custody of the baby also? This is in Ohio

The baby is technically in the custody of the 14 year old. Even though she is a minor, it is still her child. If custody of the 14 year old went to the mother, then it is up to the 14 year old to determine if she wants to keep the baby with her, or sign over the baby's custody to you. If you don't want your stepdaughter to keep custody of her child and you want to keep it, then you'll have to go to court. Most of the time you can meet up with a lawyer and do a consultation for free. They should be able to give you some more info.
the mother of the baby would have custody seeing as its her baby. but if she dosnt want it or dosnt take care of that child you can go to court for custody. Depending on how long the baby lived with you, you might gain custody, but courts seem to go for the meternal side so if the mother of the 14yr old fights she migth win but not likley if the baby has lived with you and depending for how long. its a tricky situation, but the court usually goes for whom ever is in the best interest of the baby. and they usualy go by mother first then seek out family closest to the baby, starting with the maternal side.
