THere is no illegality in another company approaching your employee. It may be a breach of his contract if he talks to them or considers taking another position without informing you. And you may be able to sue him or the other company for damages if he takes the job and subsequently passes on intellectual property that belongs to you or your company.
Unless you have an employment contract, everybody is "at will." I was told that in order for me to work at a huge computer company that I would not go to work or give any ideas to the competition. That was a work contract.
In the future, you can tell potential employees that you have an employment contract, and in order for them to work for you, they must have a contract. It also bust be bi-lateral... not a one-way street. They must get something in return for giving up something.
