Presumetively dead is legal?
my friend is separated for 3 years now.. he plan to file annulment but his wife filed presumtively dead againts his husband to marry a foreigner.. and my friend was disappointed upon knowing this because he was not inform.... what should my friend do? what case should be filed againts his wife... please help..

If you mean his wife married another because he was presumed dead - it is an automatic annulment I think until you can get divorced.
But if your friend has been gone for only a short time and he and his wife were married previously for 2+ years expect she will qualify for half of what he is worth, divorce then marry the new guy again with all your friends dosh.
If I were your friend I would just disappear again.
