My ex who still has keys to my apt came into my apt and took the keys to my car. He does not have a license and isnt' on my insurance. he has wrecked my car it is nto totaled but has alot of damage and he also hit two other cars. I have full coverage but will my insurance pay for it being as though he had the keys?...I know you have to be careful about how you word things with insurance because they won't pay. I need my car to be paid for. Do I need to press charges against him? He is currently locked up right now. i don't know what to do. and the only reason why he still has keys is because he never gave them back. we are not together at ALL.

You said he came into your apt and took the keys to your car . If he does not live there that is theft of a motor vehicle. You will most likely have to have him charged with that in order for your insurance to pay for it, And even that may be tough if you do not have uninsured motorist coverage.
If he is charged with auto theft. Your insurer should pay out under the theft clause
