My sister in law broke her wrist by slipping on some ice. She has a cast on it and it affects her job since she is a waitress at Denny's. She has a doctor's note saying she can work here and there but only as a hostess. But her work is taking her hours and giving them to other hostess saying it isnt fair to them. Can she lose her job and are they allowed to take her hours away from her because she is hurt? I just want to know if there are any legal issues. Thanks!

she should take a leave of absence until she is healed she is detrimental to the other hostesses pay
Yes you can lose a job if you are injured off work.
The employer is under no obligation to offer accommodations to her, because she has a broken wrist.
IE: reduce the normal hostesss';s schedule, to give your sister in law her normal hours she worked as a waitress, as a hostess now.
Most factories, will not let you work if you have a cast.
If you were injured on your own time, then you just do not go to work, untill cleared by a doctor, to return to work at your normal job duties.
She was hired as a waitress, others were hired as hostesses. Management should not be expected to cater only to her needs. If they are allowing her to work as hostess, they are displacing someone who was hired for that position. As for being fired, if she is unable to perform the job for which she was hired, management can give her unpaid and indefinite leave of absence until her wrist is healed. Tough situation, but it is not her manager's responsibility to take care of her problem at the expense of other employees.
Take a legal actions if they fired. She has a doctors note to proved it so theres a legal
actions for that.
Not really, but if they did fire her, I believe you can take legal action about it, especially when she has a note saying she is fit for work, what she needs to do is show more efort, even if it is hard for her
you had better turn to your doctor ,
